A hearing was held on February 23, 2024, regarding a petition filed by the applicant seeking various reliefs. The petitioner requested the commission to condone a nine-day delay in submitting the Connection Agreement to the respondent. They sought the withdrawal of a letter from the respondent dated May 31, 2023, and the restoration of the Stage-II connectivity that had been granted earlier for their 140 MW wind power project. In case this request was not granted, the petitioner alternatively asked the respondent to consider their new connectivity application submitted on May 31, 2023, in light of previous actions taken, including providing a bank guarantee and depositing a significant amount of money.
The petitioner also sought permission to amend their petition in the interest of justice and to allow any necessary changes. Another interim application was filed seeking amendments based on directives from the commission given in an order dated August 11, 2023.
During the hearing, the petitioner’s representative, Ms. Akanksha Tanvi, emphasized that the petition aimed to either get the delay in submitting the signed connection agreement condoned or to have the respondent consider the petitioner’s new connectivity application, taking into account the efforts already made for the earlier granted Stage-II connectivity.
Ms. Tanvi mentioned that the respondent, GETCO, had previously granted Stage-I and Stage-II connectivity to the petitioner through letters dated November 30, 2023. However, during the proceedings, the petitioner submitted an affidavit dated December 15, 2023, seeking permission to withdraw the petition.
Representing the respondent, Ms. Ranjitha Ramachandran confirmed that the respondent had also submitted a letter dated January 9, 2024. This letter noted that the commission had directed the filing of various documents and information in an order dated August 11, 2023. However, before these details were finalized, the petitioner had applied for connectivity on October 1, 2023, and this was granted by GETCO on November 30, 2023. Ms. Ramachandran further noted that GETCO received the petitioner’s affidavit on December 16, 2023, seeking to withdraw the petition. She expressed that GETCO had no objection to the unconditional withdrawal of the petition.
The commission acknowledged the petitioner’s affidavit dated December 15, 2023, which requested permission to withdraw the petition. During the hearing, the petitioner’s counsel reiterated the request to withdraw the matter. The commission took into consideration the affidavit and the letter from GETCO dated January 9, 2024, and decided to allow the withdrawal of the petition and the related interim applications.
With this decision, the petition, along with the associated interim applications, was disposed of as withdrawn by the petitioner. The commission concluded that no further adjudication was necessary in this matter, allowing the withdrawal to proceed without objections from either party.
