Sarjan Realties Pvt. Ltd. has filed a petition before the Gujarat Electricity Regulatory Commission (GERC) seeking an extension of time for the construction of evacuation infrastructure for its 40 MW wind power project at the 220 kV Savarkundla Substation. The company requested an additional 12 months beyond the expiry of Stage-I and Stage-II connectivity approvals, which were granted on 29 June 2024, pushing the new deadline to 28 June 2026. The petition was filed under Sections 86(1)(c), (e), (f) of the Electricity Act, 2003, along with relevant regulations, citing unforeseen events as the reason for the delay.
According to the petitioner, they were granted connectivity approvals in mid-2024 and were required to complete the evacuation system by 28 June 2025. This included the construction of lines, transformers, bus-bars, bays, and other equipment. However, complications arose due to delays by the lead generator, M/s Green Prairie Energy II Pvt. Ltd., which had not purchased land or initiated construction for the pooling substation. This affected Sarjan Realties’ ability to proceed, despite several meetings and communications with the Gujarat Energy Transmission Corporation Ltd. (GETCO).
The petitioner also highlighted that they were forced to sign an undertaking on non-judicial stamp paper, which restricted their statutory right to approach the Commission in unforeseen circumstances. Furthermore, although GETCO eventually allotted a space for a 66 kV feeder bay at the Savarkundla substation in November 2024, the final estimate for supervision charges was only issued in May 2025, after a delay of about five months. The petitioner deposited ₹9,28,077 but has yet to receive approval from GETCO.
During the hearing, GETCO argued that the petitioner still had time until 29 December 2025 to complete the work, based on earlier tariff orders, and that the undertaking had been submitted voluntarily. The Commission questioned how the petitioner could complete its evacuation system if the lead generator failed to act, and what measures GETCO had taken in this regard. The petitioner maintained that without final approvals, they could not move ahead with Section 68 and Section 164 applications for transmission works.
The Commission has now directed both parties to file their written submissions within two weeks. The matter has been reserved for order. The final decision will determine whether Sarjan Realties will be granted the extension sought till June 2026 for commissioning the project.
