The Gujarat Electricity Regulatory Commission conducted a public hearing on September 19, 2025, to discuss the tariff framework for procuring power from wind projects in the state. The hearing focused mainly on whether the new tariff order should be applied retrospectively. Several stakeholders presented their views, while some were absent despite receiving notice.
Industry representatives argued against the retrospective application of the new tariff order. They stated that the tariff should be effective either from its issuance on August 31, 2024, or from February 22, 2024, the date of the relevant regulations. They highlighted that many wind projects were developed under the 2020 Wind Tariff Order and existing agreements, and applying the new order retrospectively would negatively affect these projects. It was also suggested that benefits under the 2016 State Wind Policy, previously adopted in the 2020 tariff order, should continue, and the 2023 Renewable Energy Policy could be considered as the applicable framework.
On the other side, the utility representative argued that a retrospective order might be necessary to avoid a tariff vacuum. It was suggested that the new wind tariff order could be made effective from the date specified in the 2023 Renewable Energy Policy. Legal precedents from the Supreme Court and the Appellate Tribunal for Electricity were cited to support this approach.
The commission, consisting of two members, noted that several objectors did not attend the hearing. All parties who participated were directed to submit their written arguments within two weeks. The matter is now reserved for a final order by the commission.
