The Ministry of New and Renewable Energy (MNRE) has announced amendments to the Offshore Wind Energy Lease Rules, 2023, which were originally notified through the Ministry of External Affairs on December 19, 2023. These rules aim to regulate the leasing of offshore areas for the development of offshore wind energy projects under the Territorial Waters, Continental Shelf, Exclusive Economic Zones, and Other Maritime Zones Act of 1976.
To streamline the leasing process, MNRE has released a draft amendment to these rules, inviting comments, suggestions, and views from stakeholders within 15 days of the circular’s issuance. The new rules stipulate that the central government will identify suitable offshore areas for leasing based on wind resource assessments and subsequent marine spatial planning.
The selection of lessees will adhere to the National Offshore Wind Energy Policy, ensuring a transparent and structured approach. Before any lease is granted, necessary clearances must be obtained from various government bodies, including the Ministry of Defense, Ministry of Home Affairs, Ministry of External Affairs, Ministry of Environment, Forest and Climate Change, Department of Space, and Ministry of Ports, Shipping, and Waterways.
Leases for offshore wind energy projects will be granted for 35 years, with the possibility of extension on a case-by-case basis, depending on project viability and safety. Lessees will be responsible for conducting studies and surveys, as well as the construction, installation, commissioning, and operation and maintenance of their offshore wind energy projects, adhering to the technical standards and instructions set forth by the central government.
